Copyright and Fair Use

International copyright laws explicity state strict rules against the use and reproduction of copyright material. The Wannabe Wiki relies on the "fair use" clause present in the copyright laws of most countries. The distinction between “fair use” and infringement may be unclear and not easily defined. There is no specific number of words, lines, or notes that may safely be taken without permission. Acknowledging the source of the copyrighted material does not substitute for obtaining permission. Copyright protects the particular way an author has expressed himself; it does not extend to any ideas, systems, or factual information conveyed in the work.

As WannabeFansubs operates mainly from the United States, the copyright laws of the United States are used as a guideline. Under Section 107 of US copyright law, there is an important clause that contains a list of the various purposes for which the reproduction of a particular work may be considered "fair", such as criticism, comment, news reporting, teaching, scholarship, and research.

Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair. WannabeFansubs suggests the use of these guidelines when posting:

1. the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;
2. the nature of the copyrighted work;
3. amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
4. the effect of the use upon the potential market for or value of the copyrighted work.

Use of Images and Photos

It is WannabeFansub belief that it is legitimate, with respect to the four aforementioned points, to use copyrighted pictures and photos where they are necessary in the identification, critic, commentary of various anime or manga series. WannabeFansubs and all its affiliations are free nonprofit organizations that are NOT of commercial nature. The copyrighted material uploaded to this site in the form of graphics must not substantial or similar to the nature of the copyrighted work, and will not serve as a substitute in anyway of the original works.

WannabeFansubs reemphasizes that the responsibility to comply with copyright laws and ensure that contributions are original is with you. Due to the sheer volume of pages, it is not possible for WannabeFansubs to moderate the wiki in whole. WannabeFansubs cannot be held liable for your actions, and will remove any materials deemed inappropriate as they come to our attention.
